Eligibility Criteria

To apply for Subclass 785, you must meet the following:

General Requirements

  • Be in Australia and have arrived without a valid visa (e.g., by boat or air).
  • Engage Australia’s protection obligations as a refugee or under complementary protection
  • Meet health, character, identity, and security
  • Not be barred from applying for protection

Protection Obligations

You must demonstrate one of the following:

    You must apply for a new TPV or SHEV before your current visa expires
  • No Automatic Pathway to PR
    TPV does not directly lead to permanent residency unless eligible for Subclass 851
